1. Acceptance of terms

By accessing or using MX Moat ("the Service"), you agree to be bound by these Terms of Service. The Service is provided by MX Moat ("we", "us", "our"). If you do not agree to these terms, you may not use the Service.

2. Description of service

MX Moat is an email security gateway that filters inbound email traffic on behalf of your domain(s). The Service sits between the public internet and your existing email provider, analysing and filtering email based on sender reputation, traffic patterns, and authentication checks.

The Service is provided on a subscription basis. Features and limits vary by plan as described on our pricing page.

3. Account responsibilities

You are responsible for:

  • Providing accurate registration information
  • Maintaining the security of your account credentials
  • Ensuring the domains you register are domains you own or are authorised to manage
  • All activity that occurs under your account

4. Acceptable use

You may not use MX Moat to:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorised access to any part of the Service
  • Resell or sublicense the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Payment and billing

Subscriptions are billed monthly in advance. All prices are in EUR and exclude applicable taxes unless stated otherwise. Payment is due on the first day of each billing period.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

6. Service availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions outside our reasonable control.

7. Limitation of liability

To the maximum extent permitted by applicable law, MX Moat shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or business interruption.

Our total liability to you for any claim arising under these terms shall not exceed the amount you paid for the Service in the three months preceding the claim.

8. Changes to terms

We may update these terms from time to time. We will notify you of material changes by email or via the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

9. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
